The essence of mediation is facilitating compromise. Legal rights can be wrongs for a family, and can often turn on irrelevant technicalities. Courts spin the reality of a family into battles for underlying motivations, private issues and serious defaults in the relationships. This can be remedied to resolution in private mediation sessions rather than exposing your guts in an unfriendly and intimidating court environment. Private conversations and peaceful talks in the mediation process, are a basis for effective communication. This is why the communication with some couples occasionally reunites them. Most testimony does not need forensics. Law is often a poor means of resolving controversy, used by some as a club to force opponents to settle, rather than coming to peaceful conclusions.
"The courts of this country should not be the places where resolution of disputes occurs....They should only be the places where the disputes end after alternative methods of resolving disputes have been considered and tried." -Justice Sandra Day O'Connor
“Mediators assist couples to traverse the distance from where mis-communication was…
To where re-communication creates resolution.”
